Agreement to Terms

By accessing or using Synth Patch, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our service.

Synth Patch is operated by Human Crafted LLC, located in Wisconsin, USA.

Consent for Existing Users: These Terms of Service are effective as of October 13, 2025. Users who created accounts before November 11, 2025 (when explicit consent collection was implemented) are bound by these terms through their continued use of the Service. Your continued access to or use of Synth Patch constitutes acceptance of these Terms.


Description of Service

Synth Patch is a web application that enables users to:

  • Create interactive digital representations of hardware synthesizers
  • Configure and save synthesizer patch settings
  • Share patches with the community
  • Remix and build upon existing patches
  • Upload audio demonstrations of patches

Account Registration

Creating an Account

  • You must provide accurate and complete information
  • You must be at least 13 years old to use Synth Patch
  • You are responsible for maintaining account security
  • You must not share your account credentials
  • One person may not maintain multiple accounts for deceptive purposes

Account Responsibilities

  • You are responsible for all activity under your account
  • Notify us immediately of any unauthorized access
  • We reserve the right to suspend accounts that violate these Terms

User Content and Ownership

Your Content

You retain ownership of all patches, audio files, and other content you create or upload ("User Content").

License to Us

By uploading User Content, you grant Synth Patch a worldwide, non-exclusive, royalty-free license to:

  • Store and host your content on our servers
  • Display your content to you and users you authorize via share URLs
  • Enable sharing and remixing features as you configure them
  • Create backups and derivative formats for service operation
  • Display public patches only on Explore pages and community features

Important: We will not publicly display, distribute, or share content you mark as private. Private patches are only accessible via the unique share URL you control.

Public vs. Private Content

  • Private patches: Accessible only via unique share URL that you share
  • Public patches: Discoverable on Explore page, visible to all users
  • You control public/private status via patch settings
  • You can change privacy settings at any time

Remix Attribution

  • When remixing another user's patch, you must preserve original creator attribution
  • You cannot claim original authorship of remixed content
  • Remix relationships are automatically tracked and displayed

Acceptable Use Policy

Permitted Uses

  • Create, save, and share synthesizer patches
  • Remix existing patches with proper attribution
  • Upload audio demonstrations of your patches
  • Participate in the community respectfully

Prohibited Uses

You may not:

  • Upload malicious code, viruses, or harmful content
  • Impersonate other users or misrepresent affiliations
  • Scrape, data-mine, or automatically extract content
  • Circumvent access controls or security measures
  • Upload copyrighted audio without permission
  • Harass, abuse, or threaten other users
  • Use the service for illegal purposes
  • Spam or engage in unsolicited advertising
  • Upload explicit, offensive, or inappropriate content

Consequences

Violation of these Terms may result in:

  • Content removal
  • Account suspension or termination
  • Legal action if applicable

Intellectual Property

Our Rights

Synth Patch, including its design, code, trademarks, and branding, is owned by Human Crafted LLC. You may not:

  • Copy or modify our source code
  • Use our trademarks without permission
  • Reverse engineer our application
  • Create derivative services based on Synth Patch

User Submissions

Synthesizer configurations and component mappings you create are your intellectual property. However, by publishing patches, you agree that others may:

  • View your patch configurations
  • Remix your patches with attribution
  • Learn from your techniques and settings

Third-Party Trademarks

Synthesizer manufacturer names, model names, and trademarks belong to their respective owners. The physical design, layout, control panel arrangement, and functionality of synthesizers are the intellectual property of their respective manufacturers.

Synth Patch creates digital representations of synthesizers for educational and archival purposes. We do not claim ownership of synthesizer designs, layouts, or trademarks. Synth Patch is not affiliated with or endorsed by any synthesizer manufacturer unless explicitly stated.


Audio Content

Uploaded Audio Files

  • You must own rights to any audio you upload
  • Do not upload copyrighted material without permission
  • Audio files should demonstrate the associated patch
  • Maximum file size restrictions apply
  • Only MP3 format is currently supported

Audio Licensing

By uploading audio, you grant other users the right to:

  • Listen to your audio demonstrations
  • Use your audio to understand patch configurations
  • Share links to your audio within the platform

Copyright Enforcement and DMCA Compliance

Our Right to Review and Remove Content

Synth Patch reserves the right to review, monitor, and remove any User Content that violates copyright law or the intellectual property rights of others. This includes but is not limited to:

  • Audio files containing copyrighted music, samples, or recordings
  • Patch names, descriptions, or tags that infringe on artist names, song titles, or trademarks
  • Patch configurations or settings that misappropriate copyrighted material
  • Any other content that violates third-party intellectual property rights

We may remove infringing content with or without prior notice to you, though we will make reasonable efforts to notify you when content is removed.

DMCA Takedown Notice

If you believe that content on Synth Patch infringes your copyright, you may submit a DMCA takedown notice to our designated copyright agent:

Your notice must include:

  1. Identification of copyrighted work: A description of the copyrighted work you claim has been infringed
  2. Identification of infringing material: The URL or specific location of the allegedly infringing content on Synth Patch
  3. Contact information: Your name, address, telephone number, and email address
  4. Good faith statement: A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law
  5. Accuracy statement: A statement that the information in your notice is accurate
  6. Authority statement: A statement, under penalty of perjury, that you are authorized to act on behalf of the copyright owner
  7. Physical or electronic signature: Your physical or electronic signature

Upon receiving a valid DMCA notice, we will:

  • Promptly investigate the claim
  • Remove or disable access to the allegedly infringing content
  • Notify the user who posted the content (when possible)
  • Take appropriate action based on our findings

DMCA Counter-Notification

If you believe your content was removed in error or due to misidentification, you may submit a DMCA counter-notification to our copyright agent at legal@synthpatch.io with the subject line "DMCA Counter-Notification."

Your counter-notification must include:

  1. Identification of removed content: Description of the content that was removed and its location before removal
  2. Good faith statement: A statement under penalty of perjury that you have a good faith belief that the content was removed as a result of mistake or misidentification
  3. Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or the Western District of Wisconsin if your address is outside the United States)
  4. Acceptance of service: A statement that you will accept service of process from the person who filed the original DMCA notice or their agent
  5. Contact information: Your name, address, telephone number, and email address
  6. Physical or electronic signature: Your physical or electronic signature

Upon receiving a valid counter-notification, we may restore the content after 10-14 business days unless the original complainant files a court action seeking an injunction.

Repeat Infringer Policy

We take copyright infringement seriously. While we review each case individually, users who repeatedly violate copyright law or receive multiple valid DMCA takedown notices may face:

  • Warnings and educational outreach
  • Temporary account suspension
  • Permanent account termination
  • Legal action if applicable

We maintain discretion to determine appropriate consequences based on the severity and frequency of violations.

Good Faith Use of Copyright Complaints

False or Bad Faith Claims: Submitting false, fraudulent, or bad faith DMCA notices or counter-notifications may result in:

  • Legal liability under Section 512(f) of the DMCA
  • Damages and attorney's fees
  • Criminal prosecution for perjury

Only submit copyright claims if you genuinely believe infringement has occurred.

Limitations and Fair Use

We recognize that certain uses of copyrighted material may qualify as fair use under copyright law, including:

  • Educational purposes
  • Commentary and criticism
  • Transformative creative works
  • Short excerpts for demonstration purposes

We will consider fair use defenses when reviewing copyright claims and may decline to remove content that appears to constitute fair use.


Service Availability

No Warranty

Synth Patch is provided "as is" without warranties of any kind. We do not guarantee:

  • Uninterrupted service availability
  • Error-free operation
  • Data backup or recovery
  • Compatibility with all devices or browsers

Maintenance and Downtime

We may:

  • Perform scheduled maintenance with or without notice
  • Experience unexpected downtime
  • Modify or discontinue features
  • Upgrade infrastructure and dependencies

Data Backup

While we maintain regular backups, you are responsible for:

  • Exporting important patch data using the JSON export feature
  • Printing or saving PDF copies of patches using the print function
  • Keeping local copies of audio files
  • Maintaining your own backups of critical content

Limitation of Liability

To the fullest extent permitted by law:

No Consequential Damages

Synth Patch (Human Crafted LLC) is not liable for:

  • Lost data or content
  • Lost profits or opportunities
  • Indirect or consequential damages
  • Service interruptions or errors
  • Third-party actions or content

Maximum Liability

Our total liability for any claims related to Synth Patch shall not exceed $100 USD or the amount you paid us in the past 12 months (whichever is greater).

Indemnification

You agree to indemnify Synth Patch (Human Crafted LLC) against claims arising from:

  • Your violation of these Terms
  • Your User Content
  • Your use of the service

User Roles and Access

Role Types

  • Regular Users: Create and share patches
  • Beta Users: Early access testers with identification badge
  • Creators: Content creators with identification badge
  • Brand Users: Official manufacturer representatives with verification badge
  • Admins: Platform administrators with full access

Role Assignment

  • Roles are assigned by Synth Patch (Human Crafted LLC) at our discretion
  • Role benefits may change without notice
  • We may revoke roles for Terms violations

Termination

Your Right to Terminate

You may delete your account at any time by contacting hello@synthpatch.io.

Our Right to Terminate

We may suspend or terminate your account if you:

  • Violate these Terms
  • Engage in fraudulent or illegal activity
  • Pose a security risk
  • Fail to respond to account verification requests

Effect of Termination

Upon termination:

  • Your access to Synth Patch will be revoked
  • Your User Content may be deleted (subject to backup retention)
  • Public patches may remain visible for attribution purposes
  • You must cease all use of our service

Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be:

  • Posted on this page with an updated "Last Updated" date
  • Announced via email for significant changes
  • Effective immediately upon posting unless otherwise stated

Continued use of Synth Patch after changes constitutes acceptance of the new Terms.


Governing Law

These Terms are governed by the laws of the State of Wisconsin, USA, without regard to conflict of law principles.

Any disputes shall be resolved in the courts of Wisconsin, USA.


Miscellaneous

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Synth Patch (Human Crafted LLC).

Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.

No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right.

Assignment

You may not assign these Terms. We may assign our rights to any successor or affiliate.
